بررسی قراردادهای مشارکت در تولید به عنوان روشی جهت جذب سرمایه گذاری در صنعت نفت ایران

چکیده

قراردادهای مشارکت در تولید یکی از مهم‌ترین قراردادهای متعارف حوزه بالادستی صنعت نفت و گاز در عرصه بین‌الملل می‌باشد. این قرارداد همواره از جانب منتقدین مباحث حقوقی این صنعت، به عنوان جایگزینی مناسب برای قراردادهای نفتی بیع متقابل کشور مطرح بوده است. حال به منظور تبیین جایگاه و تناسب این قرارداد با اسناد بالادستی کشور و نیز تحلیل اصول آن از منظر مبانی شرعی، در این مقاله به واکاوی ماهیت و مهم‌ترین ابعاد حقوقی این قرارداد پرداخته خواهد شد. بدین منظور در ابتدا ماهیت حقوقی این قرارداد را تحلیل نموده و و متعاقباً به بررسی مختصر مهم‌ترین ویژگی‌های حقوقی قراردادهای مشارکتی حوزه بالادستی نفت و گاز کشور پرداخته خواهد شد و در انتها قوانین بررسی می شود تا امکان اعمال این قراردادها در بخش بالادستی نفت و گاز ارزیابی شود.

چکیده [English]

Production sharing agreements are one of the most important upstream contracts in the international oil and gas industry. This deal has always been a good substitute for the country's international oil contracts by critics of the industry. Now, in order to explain the status and suitability of this contract with the upstream documents of the country and to analyze its principles from the perspective of religious principles, this article will analyze the nature and most important legal aspects of this agreement. So achieve this goal, we first analyze the legal nature of the this agreement and then briefly review the most important legal features of the country's upstream oil and gas cooperative contracts, and finally review the laws to assess the applicability of these contracts to the upstream oil and gas sector.
